Acceptance of Terms
By accessing this website, purchasing a digital product from our Shop, or engaging Ethereal Digitals for a custom service, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use this website, purchase our products, or engage our services.
About Ethereal Digitals
Ethereal Digitals is a digital creative brand based in Lyon, France, operating two connected lines of business: a Shop of ready-made digital products — website templates, planners, finance templates, social media templates, and résumé/CV templates — and personalized digital services, including website design and development, branding, UX design, and marketing, for clients who need something built specifically for them. Throughout these terms, “we,” “us,” and “our” refer to Ethereal Digitals, and “you” refers to any visitor, customer, or client.
Digital Products & Licensing
Digital products listed in our Shop are sold and delivered through Gumroad, our third-party commerce and delivery partner. When you purchase a digital product, we grant you a non-exclusive, non-transferable license to use the files for your own personal or business projects.
Unless a product listing explicitly states otherwise, you may not resell, sublicense, redistribute, or share the source files — including as a stock asset, a template resource for others, or a component of a competing product. All design, code, and creative elements within our digital products remain the intellectual property of Ethereal Digitals.
Custom Services & Projects
For custom service engagements — website builds, branding, and similar projects — we begin with a discovery conversation to confirm scope, timeline, and pricing before any work begins. Once the details are agreed, both parties sign a service agreement covering the full project scope, requirements, timeline, deliverables, and payment terms — this protects both you and Ethereal Digitals by making sure everything agreed upon is documented in writing before any work or payment takes place.
Once the agreement is signed and you give the go-ahead to start, a 40% deposit is due to reserve your project slot and begin work. Project scope, delivery timeline, and the number of included revision rounds (up to 5) are defined in that agreement. Any request that falls outside the agreed scope may be quoted and billed separately.
Once the work is complete, we hold a review meeting to go through the deliverables together. Once everything meets the agreed requirements, the remaining 60% balance is due before final delivery. If a client is unresponsive for 15 days at any stage of the project, we may pause or close it under the terms described in Payments & Refunds below.
Payments & Refunds
Digital Products
Because digital files are delivered instantly upon purchase, Shop sales are generally final once a file has been downloaded. That said, a refund may be considered if:
- The file is corrupted, missing, or otherwise fails to download correctly, and we're unable to resolve it; or
- The product is materially different from what was described in the listing.
Refunds are not available simply because you changed your mind, purchased by mistake, or no longer need the product after it's been downloaded and works as described. To request a refund, contact us with your order details so we can look into it — refunds beyond the cases above are granted at our discretion.
Custom Services
Projects begin once we've agreed on scope and pricing and you give the go-ahead to start. At that point, a deposit of 40% of the total project cost is due and is non-refundable, as it reserves our time and covers discovery and planning work.
If a project is cancelled after work has started but before completion, you'll receive any deliverables completed up to that point, and any amount paid beyond the deposit for work not yet performed will be refunded on a pro-rata basis.
Once the work is complete, we hold a review meeting to go through the deliverables together. This includes up to 5 rounds of revisions; requests beyond that may be quoted separately. Once everything meets the agreed requirements, the remaining 60% is due before final delivery. Once the remaining balance is paid and the work is officially delivered, no refund will be issued.
If a client is unresponsive for 15 days after a request for feedback or input, we may pause or close the project. The deposit remains non-refundable, and any work completed up to that point will be delivered as-is.
These payment terms apply by default to custom service projects; the signed service agreement for a specific project may set out additional or adjusted terms, which take precedence.
Intellectual Property
Upon full and final payment for a custom service project, ownership of the final approved deliverables (for example, final website files or final logo and brand assets) transfers to the client, with the exception of any third-party assets, stock resources, fonts, plugins, or licensed components used within the project, which remain governed by their own respective licenses.
Ethereal Digitals retains the right to display completed client work in our portfolio, case studies, and marketing materials, unless a client requests otherwise in writing. All other content on this website — including text, graphics, illustrations, and page design — is the property of Ethereal Digitals and may not be copied, reproduced, or redistributed without permission.
Acceptable Use
You agree not to use this website, our digital products, or our services in any way that is unlawful, fraudulent, or harmful — including attempting to gain unauthorized access to our systems, interfering with the website's normal operation, or using our source files as the foundation for a directly competing template shop or service.
Third-Party Services
Certain functions of this website rely on third-party providers — most notably Gumroad for payment processing and digital product delivery, and our inquiry forms for handling service requests. We are not responsible for outages, errors, or policy changes on the part of these providers; their own terms and privacy policies apply to the parts of the process they handle.
Disclaimer & Limitation of Liability
This website and its content are provided on an “as is” basis. While we take care to keep information accurate and the website running smoothly, we do not guarantee that it will be uninterrupted or error-free. To the extent permitted by law, Ethereal Digitals will not be liable for indirect, incidental, or consequential damages arising from your use of this website, our digital products, or our services. Nothing in this section limits any liability that cannot legally be excluded, such as liability for fraud or for death or personal injury caused by negligence.
Governing Law
These Terms & Conditions are governed by the laws of France. Any dispute arising from these terms or your use of our website, products, or services will be subject to the jurisdiction of the competent French courts, without prejudice to any mandatory consumer-protection rights you may have under the laws of your own country of residence.
Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes in our products, services, or legal requirements. The “last updated” date at the top of this page always reflects the most recent revision. Continued use of the website after changes are posted constitutes acceptance of the updated terms.
